Professional (or Employment/Work based) visas are divided into immigrant (permanent) and non-immigrant (temporary) categories. Both categories are based on the employment of the visa applicant by a U.S. sponsor company, are subject to yearly numerical limitations, and require employment authorization by the U.S. Department of Labor. Examples of temporary work visas include H1B, H2B, L1 and J1 and TN. Permanent residence may be gained through employment sponsorship in one of 5 preference categories.

Family based permanent residency is accomplished through sponsorship by a U.S. permanent resident or citizen. These visas are available in two categories: (1) Immediate relatives and (2) Preference immigrants. There is no limit on the number of people acquiring family based permanent residency through immediate relatives. However, preference immigrants are subject to yearly numerical limitations.
